Ethical Channel

Our Commitment

At ACS Actividades de Construcción y Servicios, S.A. and our group of companies (ACS Group), we always position ourselves as a top player in whatever sector we work in, and are committed to the economic and social progress of the countries we operate in. Since the beginning, we have upheld a corporate commitment to our various stakeholders, based on the ethical principles engrained into our corporate culture that go beyond just following the law.

Our Code of Conduct embodies the ACS Group’s core values. Therefore, all the Group’s companies and divisions must make decisions and adopt behaviours that are in line with this framework. However, since we work in various jurisdictions, stricter local rules will prevail over our Code of Conduct. Nevertheless, we will not apply any local customs that may violate our Code of Conduct.

The ACS Group’s work is based on the following values: Integrity, Excellence, Trust, Sustainability, and Profitability. These ensure that a shared value is created for all its stakeholders, along with sustainable and profitable growth for its shareholders. Our conduct always goes hand in hand with our values, as we firmly believe in the benefits for the ACS Group and for society as well. It will be carried out in such a way that complying with our values naturally becomes part of our culture.

Non-compliance with these values can be reported to the ACS Ethical Channel. The ACS Compliance Committee, which reports to the Board of Directors through its Audit Committee, is the body in charge of promoting and managing the ACS Group's Ethical Channel and guaranteeing the absence of retaliation against the complainant.

The ACS Ethical Channel is available to anyone who wishes to report a possible infraction in a professional context with the ACS Group, as well as to all the Group's interlocutors and stakeholders. Our Ethical Channel Operation Policy binds the directors, managers and employees who maintain ties with the companies of the Group, regardless of the legal nature of their relationship and the people who, even though they may not be employees, are aware of the existence of any infringement in their professional relationship with ACS.

In addition, all members of the organization as well as external third parties worldwide are encouraged to use the ethical channel to report complaints related to possible breaches of the commitments and basic principles outlined in our Human Rights Policy, examples of human rights breaches may include, but are not limited to: the right to a clean healthy and sustainable environment, respect for human dignity and freedoms, right to collective bargaining, the elimination of all forms of forced or compulsory labor, the effective abolition of child labor, and the elimination of discrimination in respect of employment and occupation.

The ACS Ethical Channel allows complaints to be made anonymously. Through the digital platform of the Ethical Channel, the complainants will be able to keep in touch with the organization preserving their identity and monitoring their file. However, ACS encourages that, in the case of filing a complaint, the complainant identifies himself by providing his name, function and contact information. In this way, the personnel in charge of processing it will be able to contact the complainant for follow-up if necessary. And, at the same time, ACS believes that it is the best way to prove its Policy of Non-Retaliation in the event of a report.

In the aforementioned sense, keep in mind that when a complaint is filed (not anonymous), ACS ensures that the internal complaint procedure will be carried out in a secure manner that guarantees the confidentiality of the identity of the complainant and other information related.

All members of the organization and stakeholders are encouraged to submit information related to possible violations of our Code of Conduct, as well as to request guidance related to Compliance policies and procedures or to provide suggestions.

The information you provide us will be managed completely confidential and anonymously if you so wish. It is our commitment that your comments will be taken into account.
